Terms of Service

These Terms of Service (the "Terms") are the agreement between you and Eureka Kiwi Limited ("Eureka", "we", "us") when you use eureka.kiwi.nz and related services.

1. Who we are

Eureka Kiwi Limited, operating from New Zealand. Contact: hello@eureka.kiwi.nz.

2. Your account

You must be at least 16 to create an account. Keep your credentials secure — you're responsible for activity under your account. Notify us promptly if you suspect unauthorised access.

3. What Eureka is (and isn't)

Eureka provides career information and connects you with mentors. Career and salary information is guidance, not advice. It is not financial advice under the Financial Markets Conduct Act 2013 and we do not guarantee any employment, salary, or career outcome.

4. Pro subscription

Pro is NZ$49 per month, billed via Stripe and renewing automatically. You can cancel anytime — see the Refund & Cancellation Policy.

5. Mentor bookings

Mentors are independent contractors, not employees or agents of Eureka. We charge a 20% platform fee on the mentor's rate. Payment is captured up-front through Stripe and paid out to the mentor after the session via Stripe Connect. Cancellation, no-show and refund rules are in the Refund & Cancellation Policy. Mentor sessions are not a substitute for professional financial, legal, medical or immigration advice.

6. Acceptable use

See the Acceptable Use Policy. Breach may result in suspension or termination.

7. Your content

You keep ownership of anything you upload (CV, notes). You grant Eureka a non-exclusive, worldwide, royalty-free licence to process it as needed to operate the service and, subject to the AI Use Policy, to run AI-powered features.

8. Your consumer rights

If you use Eureka as a consumer, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 apply and nothing in these Terms excludes, restricts or modifies those rights. If you use Eureka in trade (for example, on behalf of a business), you agree the Consumer Guarantees Act 1993 and sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986 do not apply.

9. Liability

Subject to clause 8, our aggregate liability to you for any claim relating to Eureka is capped at the amount you paid us in the 12 months before the claim. We're not liable for indirect or consequential loss.

10. Suspension and termination

We may suspend or terminate your account if you breach these Terms or the Acceptable Use Policy. You can close your account at any time — see the Privacy Policy for data retention.

11. Changes

We may update these Terms from time to time. For material changes we'll notify you by email at least 14 days before they take effect.

12. Governing law and disputes

New Zealand law applies and the New Zealand courts have exclusive jurisdiction, subject to your right to use the Disputes Tribunal for claims under NZ$30,000. Please contact us first — most disputes can be resolved directly.

13. Complaints

Email hello@eureka.kiwi.nz. Unresolved consumer complaints can be escalated to the Commerce Commission (comcom.govt.nz).
